Introduction to
Specialization of International Law
In the rapidly progressing and
irreversible trend of ongoing globalization, law and its
related practice and profession have, undoubtedly, gone
international in almost all aspects of human life. From
the law of tort to taxation and from contract to
criminal law, there hardly is a branch of law which does
not have its relevant international aspect. The
International Court of Justice has declared that (i)
international law prevails over national laws; and (ii)
that in its dispute settlement national laws are nothing
more than facts. Not only there is a mushrooming of
international law firms associations, but also that of
international lawyers associations, international bar
associations, international arbitration and mediation
associations, international law students and young
lawyers associations, etc. Besides, the system of the
United Nations -- with its numerous principal organs and
specialized agencies; innumerable commissions,
committees and programmes, etc.; ever increasing number
of international courts and tribunals, etc. – offers a
great possibility for international legal careers in
various fields.
In the given reality of this globalization of law and
international career possibilities for Indian youth, the
RGNUL has introduced to offer its students the
specialization in international law. This specialization
– after having familiarizing with the basic concepts and
principles of public international law prior to the
seventh semester -- aims to provide a rigorous and
research based advanced study of those concepts and
principles of international law in general and their
application to contemporary international issues in
particular. Keeping in view (i) the current guidelines
of the Bar Council of India; and (ii) the shrinking
jurisdictions between national and international law,
the scheme of papers during the last four semesters of
B.A., LL.B.(HONS) FYIC would run as follows:
-
Seventh Semester: (i)
Labour and Industrial Law-I; (ii) law of Evidence;
(iii) International Organizations; (iv)
International Law and Good Governance; (v)
Humanitarian and Refugee Law; and (vi) Project
Report and Moot Court.
-
Eighth Semester: (i)
Labour and Industrial Law-II; (ii) Property Laws;
(iii) International Labour Organization and Labour
Laws; (iv) International Economic Law; (v)
International Criminal Law and International
Criminal Court; and (vi) Projects Report and Moot
Court.
-
Ninth Semester: (i) Law
of Equity, Trust, Limitation and Registration; (ii)
Clinical Legal Education (Alternative Dispute
Resolution); (iii) International Environmental Law;
(iv) International Human Rights Law; (v) Double
Taxation; and (vi) Project Report and Moot Court.
-
Tenth Semester: (i)
Clinical Legal Education (Drafting, Pleading,
Conveyancing and Professional Legal Ethics); (ii)
Clinical Legal Education (Public Interest Layering,
Legal Aid and Para Legal Services); (iii)
International Intellectual Property Law; (iv) Law of
the Sea; (v) International Dispute Resolution
Bodies; and (vi) Project Report and Moot Court.
With such a package of
specialization, combined with the subjects studied in
the first six semesters; the student graduating from the
RGNUL would not only be perfectly qualified and equipped
for any legal career in India -- with added asset of
international aspect of any law --but also for many
international legal careers, particularly in the system
of the United Nations and in the ever increasing
international courts and tribunals.
